Agreement to Our Legal Terms

We are Great Escape Web & Business Services LLC ("Company," "we," "us," "our"), a company registered in Idaho. We operate the website https://www.pnwpetfinder.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Site").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "your"), and Great Escape Web & Business Services LLC, concerning your access to and use of the Site. You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION CLAUSE BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND PNW PET FINDER WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

1. Our Site

The information provided when using the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. When you post content to the Site ("Contributions"), you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to use, copy, reproduce, distribute, sell, publish, and display your Contributions for any purpose. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Purchases and Payment

We accept Mastercard, Visa, American Express, and Discover. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars. You authorize us to charge your chosen payment provider for any amounts upon placing your order. We reserve the right to refuse any order placed through the Site.

6. Subscriptions

Billing and Renewal. If you sign up for a subscription, your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order.

Fee Changes. We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

7. Policy

All sales are final and no refund will be issued. Great Escape is not liable for any interaction between users off the platform.

8. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to: systematically retrieve data to create a collection or directory without written permission; trick, defraud, or mislead us and other users; circumvent or interfere with security-related features; disparage or harm us or the Site; harass, abuse, or harm another person; make improper use of our support services; upload viruses or malicious material; engage in automated use of the system; impersonate another user; interfere with or disrupt the Site; copy or reverse-engineer the Site's software; use the Site to compete with us; or sell or transfer your profile.

9. User Generated Contributions

When you create or make available any Contributions, you represent and warrant that: your Contributions do not infringe the proprietary rights of any third party; you have the necessary rights and permissions to use them; they are not false, inaccurate, or misleading; they are not unsolicited advertising or spam; they are not obscene, violent, harassing, libelous, or otherwise objectionable; they do not ridicule or abuse anyone; they do not violate any applicable law; and they do not violate the privacy or publicity rights of any third party.

10. Contribution License

By posting your Contributions to any part of the Site, you grant us an unrestricted, irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to host, use, copy, reproduce, publish, and distribute such Contributions for any purpose. We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions. We are not liable for any statements or representations in your Contributions. We have the right, in our sole discretion, to edit, re-categorize, or delete any Contributions at any time, without notice.

11. Guidelines for Reviews

When posting a review, you must: have firsthand experience with the person/entity being reviewed; not use offensive or discriminatory language; not reference illegal activity; not be affiliated with competitors if posting negative reviews; not make legal conclusions; not post false statements; and not organize a review campaign. We may accept, reject, or remove reviews in our sole discretion. Reviews are not endorsed by us.

12. Third-Party Websites and Content

The Site may contain links to third-party websites and content that are not investigated, monitored, or checked for accuracy by us. We are not responsible for any third-party websites or content accessed through the Site. If you access third-party websites or content, you do so at your own risk, and these Legal Terms no longer govern. Any purchases through third-party websites are exclusively between you and the applicable third party.

13. Advertisers

We allow advertisers to display advertisements in certain areas of the Site. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.

WE MAY TERMINATE YOUR USE OR DELETE YOUR ACCOUNT AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION. If we terminate or suspend your account, you are prohibited from registering a new account under your name or any other name.

18. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time without notice. We also reserve the right to modify or discontinue all or part of the Site without notice. We cannot guarantee the Site will be available at all times and will not be liable for any interruption, delay, or error.

19. Governing Law

These Legal Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Idaho applicable to agreements made and to be entirely performed within the State of Idaho, without regard to its conflict of law principles.

20. Dispute Resolution

Binding Arbitration. You and Great Escape Web & Business Services LLC agree that all claims and disputes arising out of or relating to these Legal Terms or the use of the Site that cannot be resolved in small claims court will be resolved by binding arbitration. YOU AND THE PNW PET FINDER PARTIES HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). Except where otherwise required, the arbitration will take place in Kootenai County, Idaho.

Restrictions. Any arbitration shall be limited to the Dispute between the Parties individually. No arbitration shall be joined with any other proceeding, conducted on a class-action basis, or brought in a representative capacity.

Exception to Arbitration. You and the PNW Pet Finder Parties are not required to arbitrate any dispute in which either party seeks equitable relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents.

21. Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update the information on the Site at any time, without prior notice.

22. Disclaimer

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

23. Limitations of Liability

IN NO EVENT WILL WE OR OUR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

24. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party arising out of: your Contributions; use of the Site; breach of these Legal Terms; breach of your representations and warranties; your violation of the rights of a third party; or any overt harmful act toward any other user of the Site with whom you connected via the Site.

25. User Data

We will maintain certain data that you transmit to the Site. Although we perform regular routine backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of such data.

26. Electronic Communications, Transactions, and Signatures

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communication be in writing. 27. California Users and Residents

28. Miscellaneous

These Legal Terms constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver. We may assign any or all of our rights and obligations to others at any time. If any provision is determined to be unlawful, void, or unenforceable, that provision is severable and does not affect the validity of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms.
